You did not do the cleaning and you did not hire anyone else to do it so why would you be entitled to money for it just because he didn't do it? It stayed dirty. You don't get money because it was dirty. She came back 1 day early - ONE. Why so picky? Or, should I say petty.

I would say no since you didn't say anything at the time.

You would lose in any court case on those items and your state law may provide you pay them back triple what you withheld.

If you're holding the security deposit you can deduct money based upon those violations.

However you may also realize that the person has the right to go before the judge and make a complaint for you withholding portions of their deposits. You had better have for yourself proof that you had somebody other than yourself perform work to repair damages left by the other party proof as in the form of receipts. Because people with hold deposits everyday and the other parties file against them with the judge every day to recover their deposits and the judge does not take kindly to the personal word of the person that withheld the security deposit and cannot prove that another party other than themselves did some kind of repair that can be deducted from the security deposit. Unless you can do that you're risking having the judge order you to pay back the security deposit plus a punitive damage which is usually seven times the amount of the security deposit. Not for the things you mention, no.

i wouldn't have deducted for the 15 days to begin with...at best I would give a $50 credit due to lower utilities, but since you did, I would not bother with the 1 day....really, did it cost you anything besides maybe a few dollars utility usage?


he or she? if you failed to say anything about the cleaning...you can't charge..you should have issued a cure or quit notice back then...at best you can claim they didn't leave the bathroom clean and deduct for 1 cleaning.
