I have two questions: 1. When a minor turns 18 while living with parents in an apartment...... (in the middle of a lease).... Can the parents kick her out (on their own, without the Lanlord's consent)? and my next question.... 2. let's say

Answers:

1. Yes, the parents can kick out the child but, that would not be very nice, unless the child is horrible. Landlords do not tell parents how to raise their children. 2. If the landlord evicts the child, the parents will be evicted too. It's all or nobody. However, the parents can evict the child but, they should not have to evict their own child. They should only have to give the kid a month to find a place of his/her own.

The answer to this will vary depending on where you live. Where I live (Ohio), you’d likely be an occupant listed on the lease. Meaning, you are allowed to occupy the unit, but you’re not financially responsible. That means that you can actually exit the lease at any time. If your parents wanted you out, hypothetically, they would provide you with some kind of notice (usually 30 days) and notify the landlord that you’d be gone by that date. Then they could simply have the locks changed.

In the second scenario, you would ONLY be allowed to sign the lease if you qualified as a leasesigner. Meaning, you’d have to apply and meet the approval criteria to be added as a leaseholder. If that occurred, you would be financially responsible for the less (alongside your parents).

No landlord is going to evict an occupant. They’d just change the locks. Landlords don’t typically evict over roommate disputes, either. Eviction is for issues like non-payment or serious lease violations.

An adult living in the apartment has to get checked out but does not normally become responsible for rent payment- so they are not automatically added to the lease. And not normally. A child that becomes an adult does not automatically become some sort of magic person that a parent can't kick out. When they kick you out you would need to move out or file a lawsuit with the help of a lawyer. I think you will find that you have very little or no right to force your parents to keep you in their home after you become 18.

Anyone can be evicted under certain conditions. A child (regardless of age) who is not on the lease could be "kicked out" by the parents without violating the lease. A legal adult child can live with parents without being on the lease. An adult child does not have the right to sign a lease if the parents who are renewing the lease don't want them to. To even qualify to sign the lease, the adult child would have to have the income necessary. That just rarely happens. The parents could still evict the child on the lease as long as they cover the cost/rent. The adult chlld would still be legally responsible on the lease. You are mixing up legal financial responsibility (lease) with the "right" to live somewhere. They are not the same thing.

If you have two parents, their names are probably on the lease. Unless you start chipping in on rent, to the tune of 50 percent of it or more each month, I hardly think the landlord or your parents will allow you to sign the lease. The parents can put you out, at any time they choose.
